Terms and Conditions of Sale (TCS)

1. Legal Notice

These Terms and Conditions of Sale (TCS) govern the relationship between:

  • L’Agence de Marie, a sole proprietorship located at 50 Rue des Franciscains, 68100 Mulhouse, France, registered under number [insert SIRET number], represented by Marie Meichler as Director,
    hereinafter referred to as « The Agency »,
    and any individual or legal entity wishing to make a purchase via The Agency’s website (hereinafter referred to as the « Client »).

2. Purpose

These TCS are intended to define the terms and conditions of the sale of services offered by The Agency via its website, including coaching services, masterclasses, and the creation of artistic events. Any order placed on this website implies full and unconditional acceptance of these terms by the Client.

3. Acceptance of the TCS

By validating an order on The Agency’s website, the Client acknowledges having read and accepted these TCS without reservation. The Agency reserves the right to modify its TCS at any time, with the applicable conditions being those in force on the date of the order.

4. Services Offered

L’Agence de Marie mainly provides services related to artistic development and support for creators, including:

  • Coaching sessions: Individual or group coaching sessions aimed at guiding artists in their personal and professional development, helping them achieve their goals and overcome challenges in their careers.
  • Masterclasses for artistic career development: Thematic workshops (online or in-person) to teach and enhance key skills in the artistic field, including career management, creative development, artistic promotion, and monetizing one’s art.
  • Creation of artistic events: Organization and management of artistic events, exhibitions, performances, or other initiatives aimed at promoting artists’ works and increasing their visibility to the public and professionals.

These services are described in detail on the website, with specific information on their content, objectives, and execution methods. The Agency commits to providing the services as described on the site, subject to minor adjustments necessary to ensure their proper execution.

5. Orders

Orders are placed directly online via The Agency’s website. By validating the order, the Client agrees to these TCS. The information provided by the Client when placing the order (including their email address) is binding. The Agencycannot be held responsible for any errors in the Client’s contact details that could lead to mistakes in the service execution.

6. Pricing

The prices of the services are indicated in euros and exclusive of tax (VAT). Any additional fees (such as taxes, VAT, travel costs, etc.) are mentioned before the order is confirmed. The Agency reserves the right to modify its prices at any time. However, the applicable price is the one in effect at the time of the order.

7. Payment Terms

Payment is made when the order is placed via the payment methods available on the website (credit card, bank transfer, etc.). For bank transfers, services will only begin once full payment has been received. If payment is not made on time, The Agency reserves the right to suspend or cancel the provision of the service.

8. Delivery Times

The delivery times for the services are defined when the order is placed. The Agency commits to meeting these deadlines, except in cases of force majeure (strikes, pandemics, natural disasters, etc.). In case of delays, The Agencywill inform the Client as soon as possible and propose a new schedule.

9. Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the Client has a 14-day period from the conclusion of the contract to exercise their right of withdrawal without having to justify their reasons or pay any penalties. However, under Article L221-28 of the same code, this right cannot be exercised if the service has been fully performed before the end of the withdrawal period and if execution has begun with the Client’s agreement.

10. Cancellation and Termination

If the Client cancels the order after it has been confirmed, cancellation fees may be charged depending on the stage of the service. The Agency reserves the right to terminate a contract if the Client commits a serious breach of their obligations (non-payment, failure to provide necessary information for the service, etc.).

11. Liability

L’Agence de Marie strives to ensure Client satisfaction but cannot be held liable in the event of:

  • Technical issues affecting the website or the ordering process,
  • Damage resulting from misuse of the service by the Client,
  • Delays or non-performance due to force majeure events.

In any case, The Agency’s liability will be limited to the amount of the order placed.

12. Intellectual Property

All visual, textual, or other content published by L’Agence de Marie on its website remains the exclusive property of The Agency. Any reproduction, exploitation, or redistribution without authorization is strictly prohibited.

13. Personal Data Protection

In accordance with Law No. 78-17 of January 6, 1978, on Information Technology and Civil Liberties, and the General Data Protection Regulation (GDPR), the information collected from the Client when placing the order is necessary for managing the service. The Client has the right to access, rectify, and delete their personal data, which can be exercised by contacting The Agency at: contact@agence-de-marie.com.

14. Governing Law and Disputes

These TCS are governed by French law. In the event of a dispute that cannot be resolved amicably, the Client may seek mediation services for consumer disputes, in accordance with Article L612-1 of the French Consumer Code. Failing that, any dispute will be submitted to the competent courts under the jurisdiction of the Court of Appeal of Mulhouse.
